1. Acceptance of Terms

By accessing and using this website, you agree to be bound by these Terms of Service and our Privacy Policy. If you authorize SMS communications, by using the services of Dagmar Horvath, M.D., you agree to receive customer care messages. (Message frequency may vary. On average, 1-2 messages per month). If you do not agree to these terms, please do not use this website and our services.

2. Medical Services

2.1 Scope of Practice

Dagmar Horvath, M.D. provides:

  • Pediatric and family medical care
  • Laser pain management and acne treatment
  • Healthy lifestyle training and counseling
  • CLIA-certified laboratory services
  • Specialized care for problem children

2.2 Insurance and Payment

  • We accept PPO insurance plans only
  • Low-cost private office visits available
  • Free consultation for new patients
  • Payment is due at time of service unless other arrangements are made

3. SMS Communication Services

3.1 GoTo VoIP SMS Service

We use GoTo VolP services for SMS communications. By providing your mobile phone number, we do not use your number for SMS messaging unless you request us to do so. We utypically limit SMS use to customer care messages only. By using this website you agree to:

  • Receive SMS messages related to your customer care
  • Comply with GoTo's terms of service and acceptable use policy
  • Accept responsibility for message and data charges from your carrier
  • Accept the frequency of SMS messages that is primarily controlled by you and by how many appointments and contacts you initiate with us each month. The frequency may vary. We estimate as between 1-2 messages per month, when averaged over all of your patients. For more information on how your data is handled, please review our privacy policy.

3.2 SMS Usage Guidelines

  • We encourage you to call our office instead of using SMS
  • SMS messages are for healthcare-related communications only
  • Do not use SMS for emergency medical situations
  • •Reply "STOP" to opt-out of SMS messages at any time
  • We generally do not use SMS. Only message "HELP" if you need help with an SMS message. "HELP" in a communciation between doctor and patient has a very specific and alarming context. If you need medical help, PLEASE CALL OUR OFFICE, OR 911 IF IT IS AN EMERGENCY.

3.3 SMS Service Availability

SMS services are provided "as is" and may be subject to:

  • Carrier network availability and delays
  • Technical maintenance and updates
  • Service interruptions beyond our control

4. Appointments and Scheduling

  • Appointments must be scheduled in advance
  • 24-hour notice required for cancellations. No cancellation by SMS messaging
  • No-show fees may apply for missed appointments
  • Emergency appointments available during office hours
  • We strive to minimize wait times and see patients promptly

5. Patient Responsibilities

5.1 Information Accuracy

Patients must provide accurate and complete information regarding:

  • Medical history and current symptoms
  • Insurance coverage and contact information
  • Current medications and allergies
  • Emergency contact details

5.2 Treatment Compliance

  • Follow prescribed treatment plans
  • Attend scheduled follow-up appointments
  • Report adverse reactions or concerns promptly
  • Maintain open communication with healthcare providers

6. Website Use

6.1 Permitted Use

Our website may be used for:

  • Learning about our services and practice
  • Reading announcements and healthcare commentary
  • Contacting our office for appointments

8.2 Technology Services

We are not liable for:

  • SMS delivery failures or delays
  • Website downtime or technical issues
  • Third-party service interruptions
  • Data loss due to technical failures

9. Emergency Situations

IMPORTANT: Do not use SMS, email, or our website for medical emergencies. In case of emergency:

  • Call 911 for life-threatening emergencies
  • Go to the nearest emergency room

10. Intellectual Property

11.1 GoTo VoIP

SMS services are provided through GoTo VoIP. GoTo's terms of service and privacy policy also apply to SMS communications. We are not responsible for GoTo's service performance or policies.

11.2 Insurance Providers

We work with PPO insurance providers but are not responsible for coverage decisions, claim denials, or changes in insurance policies.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with the updated date. Continued use of our services constitutes acceptance of the modified terms.

13. Termination

We reserve the right to terminate services for:

  • Non-payment of fees
  • Violation of these terms
  • Abusive or inappropriate behavior
  • Non-compliance with treatment recommendations

14. Governing Law

These Terms of Service are governed by the laws of the state where our practice is located. Any disputes will be resolved through binding arbitration or in local courts.
